CSIC's Motion to Stay the Minister's Decision is Dismissed
On Thursday June 9, the Hon. Madame Justice Judith Snider, having heard the parties on June 7 in Vancouver, dismissed a Motion brought by CSIC to stay the decision of the Minister until the underlying application for leave and judicial review has been determined.
In making her decision, Madame Justice Snider had to consider three issues that had to be met.
1. Is there a serious question to be tried? 2. Will CSIC suffer irreparable harm if the injunctive relief is not granted? 3. Does the balance of convenience favour CSIC?
Madame Justice Snider accepted that there is a serious issue, however that CSIC had failed to establish that it would suffer irreparable harm if this injunctive relief was not granted.
